1. Agreement to Terms

By accessing or using the ACTION PHOTO TOURS LLC website ("Site") or booking any of our photo tour or photography education services ("Services"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use our Site or Services.

2. Description of Services

ACTION PHOTO TOURS LLC provides:

  • Guided photo tours in national parks, deserts, and scenic locations
  • Landscape and night photography training
  • Camera workshops and equipment instruction
  • Individual and group photo expeditions
  • Photo editing training and education

3. Booking and Payment

3.1 Reservations

All bookings are subject to availability. A booking is confirmed only upon receipt of payment or deposit as specified during the booking process.

3.2 Pricing

All prices are listed in US dollars and are subject to change without notice. Prices include applicable taxes unless otherwise stated. Certain tours may have additional fees for permits, park entrance, or special access.

3.3 Payment

We accept payment via credit card, bank transfer, or other methods as specified during booking. Full payment is required before tour commencement unless a deposit arrangement has been agreed upon.

4. Cancellation and Refunds

4.1 Cancellation by You

  • Cancellations made 30+ days before scheduled tour: Full refund minus a 10% processing fee
  • Cancellations made 14-29 days before scheduled tour: 50% refund
  • Cancellations made less than 14 days before scheduled tour: No refund

Rescheduling may be available subject to availability and at our discretion.

4.2 Cancellation by Us

We reserve the right to cancel tours due to weather, safety concerns, minimum participant requirements, or other circumstances beyond our control. In such cases, you will receive a full refund or the option to reschedule.

5. Participant Requirements

5.1 Age and Capacity

Participants must be at least 18 years old or accompanied by a parent or legal guardian. All participants must have the physical capacity to participate in tour activities.

5.2 Equipment

Participants are responsible for providing their own camera equipment unless otherwise specified. We can provide equipment recommendations upon request.

5.3 Health and Safety

Participants must disclose any health conditions that may affect their participation. We reserve the right to refuse service if participation poses a safety risk.

6. Assumption of Risk and Waiver

Photo tours involve inherent risks including but not limited to: uneven terrain, weather conditions, wildlife encounters, and physical exertion. By participating, you acknowledge and assume all risks associated with tour activities. You agree to release, waive, and discharge ACTION PHOTO TOURS LLC from any liability for injury, loss, or damage arising from your participation.

7. Intellectual Property

7.1 Your Photographs

You retain ownership and copyright of all photographs you take during our tours and workshops.

7.2 Our Content

All content on our Site, including text, images, logos, and design elements, is the property of ACTION PHOTO TOURS LLC and is protected by copyright and other intellectual property laws.

7.3 Promotional Use

With your consent, we may use photographs from tours for promotional purposes. We will always request explicit permission before using your images.

8. User Conduct

When using our Site or Services, you agree not to:

  • Violate any applicable laws or regulations
  • Interfere with the safety or enjoyment of other participants
  • Damage or interfere with natural environments or park property
  • Use our Site to transmit harmful code or unauthorized content
  • Attempt to gain unauthorized access to our systems
  • Provide false or misleading information

9. Limitation of Liability

To the maximum extent permitted by law, ACTION PHOTO TOURS LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our Site or Services. Our total liability shall not exceed the amount you paid for the specific service giving rise to the claim.

We do not guarantee specific photography results. Outcomes depend on factors including weather, equipment, and individual skill.

10. Indemnification

You agree to indemnify and hold harmless ACTION PHOTO TOURS LLC, its officers, agents, and employees from any claims, damages, losses, or expenses arising from your use of our Site or Services, or your violation of these Terms.

11. Dispute Resolution

Any disputes arising from these Terms or our Services shall first be attempted to be resolved through good-faith negotiation. If negotiation fails, disputes shall be resolved through binding arbitration in the State of Utah, in accordance with the rules of the American Arbitration Association.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Utah, without regard to its conflict of law provisions.

13. Changes to Terms

We reserve the right to modify these Terms at any time. Changes will be effective upon posting to our Site. Your continued use of our Site or Services after changes constitutes acceptance of the modified Terms.

14. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions shall continue in full force and effect.

15. Entire Agreement

These Terms, together with our Privacy Policy and Cookie Policy, constitute the entire agreement between you and ACTION PHOTO TOURS LLC regarding your use of our Site and Services.
